1. Scope

These Terms of Use apply to the use of the “counter.gratis” service, in particular to the embed code, counter graphic, statistics pages, as well as style/generator functions and any additional features.

2. Service description

The service provides a visitor counter for embedding in websites/projects as well as related online statistics.
The service is currently offered free of charge. There is no entitlement to specific features, a specific availability, error-free operation, or permanent free use.

3. Use without contact details / Notices

No registration with an email address is required to use the service.
The user is aware that the provider therefore cannot always contact or warn the user individually.
Notices may be provided at the provider’s discretion via messages on statistics pages, status pages, or publicly available information. There is no entitlement to such notices.

4. Embed code, display, link requirement

The user may use the embed code provided by the service for their own websites/projects.
The link is a mandatory component: The link included in the embed code (e.g., to the service’s statistics/home page) is part of the provided functionality and must not be removed, obscured, or technically rendered ineffective.
No hiding: The counter and the link must not be intentionally made invisible or “hidden” (e.g., display:none, visibility:hidden, offscreen positioning, 0-pixel sizes, transparent overlays, layers/frames that intercept clicks or intentionally prevent visibility).
No manipulation: Changes to the embed code are only permitted insofar as they do not impair the functionality, security, measurement, or accessibility of the service. In particular, changes that falsify measured values (e.g., artificial reload loops, automated requests) or misusefully burden the service are prohibited.
If the provider delivers link attributes (e.g., rel attributes) in the code, these must not be removed or altered.
A counter may only be used for the corresponding ID/website. Any improper use (e.g., for other domains/projects) is prohibited.

5. Permitted use / Prohibited content

The service must not be used on websites/projects that violate applicable law or that typically promote unlawful or immoral content.
In particular, websites/projects involving glorification of violence or calls to violence/criminal acts, extremist propaganda, incitement of hatred, inhumane hate speech, pornography, prostitution, fraud/scams, phishing, malware, or infringements of copyright, trademark, or personal rights are prohibited.
The provider may refuse use for such sites and may block, deactivate, or delete counters/IDs.

6. Responsibility for content of user sites / Reporting office

The user is solely responsible for the content and operation of their website. The provider does not adopt third-party content as its own and does not generally monitor user sites on an ongoing basis.
Upon indications of legal violations or rule violations, the provider may block or deactivate counters/IDs.
Please report abuse/legal violations to: admin@besucherzaehler.gratis (with URL, short description, and if possible a screenshot).

7. Abuse prevention / Technical protective measures

The provider may implement technical measures to prevent abuse (e.g., rate limits, filters, block lists, bot/manipulation detection).
The user must not circumvent or deliberately impair these protective measures.

8. Availability / Maintenance

The provider strives for the highest possible availability but cannot guarantee it.
Maintenance, updates, technical disruptions, or external factors (e.g., provider/network outages) may lead to limitations.

9. Advertising

The service is currently free of charge and may be ad-free.
The provider is entitled to display advertising on provider-operated pages—especially statistics pages—or to test monetization methods. There is no entitlement to an ad-free service.

10. Rights / License

The service (software, designs/styles, graphics, texts, evaluations) is protected by copyright.
The user receives a simple, non-transferable right to use the embed code for their own websites/projects as long as these Terms of Use are complied with.

11. Data protection / User’s duty to inform

Information about data processing is provided in the service’s privacy policy (link).
The user is responsible for informing their website visitors about the use of the service, insofar as this is required.

12. Storage, inactivity, deletion of counter IDs

The service stores statistical data to the extent necessary for operation, evaluation, and abuse prevention.
Inactivity: Inactivity exists if over a continuous period of 12 weeks no calls of the counter graphic occur, i.e. no HTTP request reaches https://besucherzaehler.gratis/counter.php that contains the parameter ID=User ID — regardless of further parameters.
In the event of inactivity, the provider may deactivate, anonymize, or delete the ID and associated statistical data.
Deletion request: The user can request deletion of an ID by email to admin@besucherzaehler.gratis. For abuse prevention, the provider may require suitable proof (e.g., proof of control over the website/domain).
There is no entitlement to restoration of deleted data/IDs.

13. Blocking, deactivation, termination

The provider is entitled to immediately block or deactivate counters/IDs if a violation of these Terms of Use exists or is likely, if abuse/manipulation/security risks exist, or if this is necessary for damage prevention or legal enforcement.
No obligation to warn: Due to a potentially missing contact address, there is no entitlement to prior notification or warning.
Where possible, a notice may be displayed on the statistics page (e.g., “Counter deactivated”). There is no entitlement to such a notice.
The provider may change or discontinue the free service as a whole or individual functions at any time, in particular for technical, economic, or security-related reasons.

14. Liability

Unlimited liability in cases of intent and gross negligence as well as in cases of injury to life, body, or health.
In cases of slight negligence, the provider is only liable for breach of essential obligations and limited to the typically foreseeable damage.
No specific accuracy of measurements/statistics is owed; ad blockers, browser/network settings, bots, or misconfigurations can influence values.

15. Changes to these Terms of Use

The provider may adapt these Terms of Use if there are objective reasons (e.g., legal changes, security, abuse situation, functional changes).
Changes will be announced on the website. Continued use after they take effect is deemed acceptance unless the user objects.
